Case Study:

Case stems from allegations of physical abuse and neglect of children by Mom and Stepdad. This was not the first time that Department of Children and Families had been called however none of the previous reports were ever screened in. This time, the reports of physical abuse were alleged by the oldest Child who claimed that Mom was physically harming the younger child in order to restrain them when they were misbehaving. Oldest child also claimed that Stepdad would be verbally abusive as well as physically threatening as well.

Child made an outlandish claim that Stepdad had taken him to an old warehouse and yelled at him for two hours after recording the mother sitting on the younger misbehaving child. DCF took these claims firsthand and based their entire report upon these claims. As a result they made a decision of substantiated concern for neglect and physical abuse against Mom. The DCF report was filled with inconsistencies according to Mom and Stepdad. There were many instances that they believed that their religious background had influenced DCF’s profiling. After they found that their rights were violated, they immediately contacted Attorney Seaver.

Attorney Seaver was able to design a plan to dismantle the false allegations and found the child’s story inconsistent with what had actually occurred.From this point forward DCF was much more understanding and non-judgmental of Mom and Step-Dad because they understood that this neglect and abuse had not occurred. DCF closed the case and did not return to the home from that point forward, because Mom and Step-Dad proved that they were not abusive or neglectful of the children.
