Case Study:

A call was made to the Massachusetts Department of Children and Families (DCF) after law enforcement officers responded to the parents’ house. This situation could potentially lead to a DCF investigation process, initiated by a call from an anonymous individual suspecting that domestic abuse had taken place. Officers found shoes and other belongings scattered on the floor, raising concerns about the living environment. In such cases, it’s crucial for parents to understand what are my rights during a DCF investigation, to ensure they are adequately prepared and informed.

The police believed a domestic disagreement occurred, and possibly occurred in front of the children. A mandated reporter called in A 51A report to DCF who took the messy home as enough evidence to support allegations of child neglect against Mom and Dad. Mom and Dad had a verbal disagreement in the parking lot of a bowling alley. The parents had a couple of drinks, and Mom did not feel safe with Dad driving. A friend picked the couple up and drove them back home. When DCF made contact with Mom about the allegations against her and her husband, she immediately thought her children would be taken away.

Terrified and frustrated, Mom reached out to a close friend who heard good things about Attorney Seaver. Mom and Dad decided to give him a call. Attorney Seaver responded quickly and immediately made Mom and Dad feel reassured and comfortable. He took on the parents’ case and was there every step of the way to protect Mom and Dad through the 51B investigation process. He made a plan and provided the investigator with all necessary information to prove Mom and Dad’s innocence.

In under two weeks, Attorney Seaver was able to work with the Department and the parents to get the case closed quickly, effectively handling the DCF investigation process. It was a huge weight off of Mom and Dad’s chests knowing their children would not be taken away. Mom and Dad feared that the Department would obtain custody of the children and place them in foster care, a concern often associated with parents’ rights against DCF. Mom and Dad were always at ease knowing Attorney Seaver was on their side. There was nothing that Attorney Seaver could have done better.
