The allegations occurred in public, not at Joseph’s home where no misconduct allegations arose. These allegations have serious implications and have caused concern by DCF to support these allegations of abuse.

Grandfather’s Character and Background
Joseph is a respected professional. He, in his early seventies, boasts a distinguished 50-year career. He has never encountered any arrests or affiliations with government protective services agencies. His record was squeaky clean by all accounts.

The Defense
The defense highlighted several key points, such as questioning the standard used by DCF in determining abuse. DCF based its conclusion on the subjective nature of abuse. According to the Supervisor’s Comment, the grandfather reports that if he did touch her, it was incidental and not intentional. DCF further mentioned that even if that is true, Alexandra did not like the touching. It has impacted on her mental health as she has struggled since returning home for the winter. The subjective definition is different from what the regulation requires. The touching was incidental and accidental, and therefore, it was not abuse.
