Abuse is not dependent upon location (i.e., abuse can occur while the child is in an out-of-home or in-home setting.)

According to the Supervisor’s Comment, the grandfather reports that if he did touch her, it was incidental and not intentional. DCF further mentioned that even if that is true, Alexandra did not like the touching. It has impacted on her mental health as she has struggled since returning home for the winter. The subjective definition is different from what the regulation requires. The touching was incidental and accidental, and therefore, it was not abuse.
