MA DCF Case Study: How a Mother Was Wrongly Apart of Allegations of Abuse Against The Dad

Case Study:

This case involved a Mom being wrongfully alleged of neglect for Dad’s actions. Initially, Mom learned of allegations of sexual abuse that had been filed against Dad. Mom and Dad were divorced and Dad no longer lived in the family home. Mom met with DCF in good faith and defended Dad, explaining that the allegations were false. DCF then turned around on Mom and served her with neglect. Mom was never told she was part of the investigation of Dad by DCF. The allegations came as a surprise and completely blindsided Mom.

This violated Mom’s due process rights, as she was given no indication that she was being investigated. The neglect against Mom was supported for Substantiated Concern. Mom reached out to Attorney Kevin Seaver in hopes of ending her involvement with the Department. Social workers had been constantly visiting the home; Attorney Seaver put an end to this. From this information it could be clearly seen that Mom’s rights had been violated and that the allegations had been supported under false pretenses. Attorney Seaver gave to DCF Supervisor all the info that showed DCF had no reason to support neglect. Attorney Seaver also filed a motion, and the Area Director agreed to close the case. Mom was happy to have DCF out of the family’s life. After months of dealing with the Department, Mom’s case was finally closed.
